The state of Arizona is known to be strict when it comes to drinking and driving. And if caught drinking and driving with a child in the car, you could face even harsher penalties along with the risk of being charged with child neglect or child abuse

Aggravated DUI

If driving with a blood alcohol content of .08 or higher while driving in Arizona and with a child under the age of 15 in the car, then it is considered an aggravated driving under the influence charge. Regardless of it being your first offense or not, an aggravated dui is also a class 6 felony.

1st Offense

A 1st offense aggravated dui charge could lead to the following penalties:

  • Up to 2 years in jail (mandatory 1 day in jail)
  • Minimum of $4,600 in fines
  • Driver’s license revoked for at least 1 year
  • Mandatory alcohol counseling
  • At least 2 years of ignition interlock

2nd Offense

A 2nd offense aggravate dui charge could lead to the following penalties:

  • Up to 4 years in prison (mandatory 30 days)
  • Minimum of $9,000 in fines
  • Driver’s license revoked for at least 3 years
  • Mandatory probation with a maximum of 10 years
  • At least 2 years of ignition interlock

Child abuse or neglect

When charged with an aggravated dui, not only are you facing those consequences, but you could also be charged with child abuse or child neglect. Driving under the influence with a child in the vehicle is putting the child in danger. Depending on the circumstances, you could face child custody issues as well.

If you have been charged with an aggravated dui in Arizona, you want to work with an experienced Scottsdale child abuse lawyer to know your options and if you are facing any child abuse or child neglect charges. You also want to work with your lawyer to try and get the aggravated factor dropped so you face less severe consequences.
